Câu chuyện tranh chấp thương mại Mỹ – Trung đã kéo dài hai thập kỷ. Trong suốt thời gian ấy, việc Trung Quốc luôn không tuân thủ các quy tắc thương mại toàn cầu đã làm suy yếu sự thịnh vượng của người Mỹ, theo Đại diện Thương mại Hoa Kỳ Katherine Tai.
Hoa Kỳ và Trung Quốc đã tổ chức các cuộc đàm phán thương mại cấp cao vào cuối tuần qua. Trung Quốc yêu cầu Hoa Kỳ phải nới lỏng các hạn chế thương mại và đầu tư, trong khi không muốn nhượng bộ bất kỳ điều gì.
Trước khi nói chuyện với Phó Thủ tướng Lưu Hạc phía Trung Quốc, bà Tai giải thích rằng Hoa Kỳ muốn Trung Quốc phải chấm dứt sự hỗ trợ của nhà nước đối với các công ty Trung Quốc, và Bắc Kinh phải tuân thủ luật chơi chung. Bà Tai cho biết bà sẽ nói chuyện cởi mở với các quan chức Trung Quốc, đồng thời cũng sẽ cảnh báo rằng Hoa Kỳ sẽ thực hiện “tất cả các bước đi cần thiết” để bảo vệ người dân khỏi chủ nghĩa trọng thương của Bắc Kinh.
Hoa Kỳ hiện áp đặt các hạn chế đầu tư và thương mại đối với 900 thực thể của Trung Quốc, và Trung Quốc muốn phía Hoa Kỳ nhanh chóng dỡ bỏ điều này. Ngoài ra, Hoa Kỳ đang cân nhắc thực hiện một cuộc điều tra thuộc Mục 301 về các khoản trợ cấp không công bằng của chính quyền Bắc Kinh. Điều này dẫn đến việc Hoa Kỳ có thể áp dụng nhiều biện pháp thuế quan hơn trong tương lai.
Trong một cuộc phỏng vấn trên truyền hình, Đại sứ Trung Quốc tại Mỹ, ông Tần Cương, phát biểu: Các hạn chế của Mỹ là không công bằng. Ông Tần đe dọa nếu Hoa Kỳ không chấp nhận các yêu cầu từ phía Trung Quốc thì nước này sẽ phải gánh chịu những hậu quả nghiêm trọng.
Theo bà Tai, Trung Quốc đã thực hiện các hành vi bóp méo thị trường từ khi họ gia nhập Tổ chức Thương mại Thế giới (WTO) năm 2001. Quyền tiếp cận tương đối tự do vào thị trường Hoa Kỳ và các thị trường nước ngoài khác, kết hợp với sự hỗ trợ từ Bắc Kinh, và việc thiếu trách nhiệm trong giải trình đã cho phép Trung Quốc thống trị thị trường toàn cầu về thép và tấm pin mặt trời. Hiện tại, Trung Quốc đang nỗ lực thống trị cả thị trường công nghệ, chất bán dẫn, và nguyên liệu thô.
Đối với thỏa thuận thương mại Giai đoạn I được ký với cựu Tổng thống Donald Trump, Trung Quốc mới chỉ mua khoảng 50% khối lượng hàng hóa từ Mỹ mà họ cam kết. Ông Tần bác bỏ cáo buộc rằng hàng hóa từ Trung Quốc đến Mỹ không tuân theo các điều khoản, và khẳng định Trung Quốc đã thực hiện “các bước đi bền vững” để tuân thủ thỏa thuận.
Ngoài các hành vi thương mại không công bằng, chính quyền Bắc Kinh còn ‘luồn lách’ các chuẩn mực quốc tế để tận dụng thị trường đầu tư ở Mỹ. Do đó, Hoa Kỳ đã cấm các đợt IPO mới của các công ty Trung Quốc và yêu cầu các doanh nghiệp đã niêm yết tại Hoa Kỳ phải tuân thủ các yêu cầu kiểm toán và công bố thông tin, nếu không sẽ bị hủy niêm yết.
Việc hạn chế các đợt IPO của Trung Quốc xuất phát từ thực tế nhiều công ty Trung Quốc đang niêm yết trên các sàn giao dịch của Hoa Kỳ thông qua các công ty vỏ bọc (hay còn gọi là các công ty ma). Theo các quy định mới, doanh nghiệp Trung Quốc sẽ buộc phải công bố thông tin chính xác về việc các nhà đầu tư Hoa Kỳ đang đổ tiền của họ vào một công ty vỏ bọc ở nước ngoài, thay vì công ty thực ở Trung Quốc. Trong nhiều năm, các công ty công nghệ Trung Quốc đã sử dụng các Mô hình sở hữu đặc biệt (VIE) để lách các quy định của Bắc Kinh trong việc cấm người ngoại quốc sở hữu cổ phần trong các công ty công nghệ Trung Quốc.
Các nhà đầu tư Hoa Kỳ không sở hữu các công ty thực (mà họ tin rằng họ đang sở hữu). Do vậy, nếu các công ty vỏ bọc không thể trả cổ tức hoặc biến mất thì các nhà đầu tư Hoa Kỳ sẽ không có quyền truy đòi hợp pháp, vì VIE là bất hợp pháp theo luật pháp Trung Quốc. Để bảo vệ các nhà đầu tư Hoa Kỳ, Chủ tịch Ủy ban Chứng khoán và Giao dịch (SEC) Gary Gensler đã yêu cầu việc tiết lộ thông tin liên quan đến “các tổ chức phát hành ra nước ngoài liên kết với các công ty có trụ sở tại Trung Quốc” trước khi cho phép họ đăng ký.
ĐCSTQ nói rằng họ có thể thông qua một đạo luật, cấm các công ty viễn thông Trung Quốc niêm yết ở nước ngoài, bao gồm cả việc niêm yết thông qua một công ty nước ngoài. Điều này có thể khiến hàng nghìn tỷ USD cổ phiếu Trung Quốc bị loại khỏi danh sách niêm yết tại Hoa Kỳ, từ đó làm tổn hại nhiều nhà đầu tư Mỹ.
Theo luật pháp Trung Quốc, các công ty nước này không được phép chịu sự kiểm toán của Hoa Kỳ. Do vậy, các nhà lập pháp Hoa Kỳ đã đề xuất một đạo luật có tên là “Đạo luật chặn IPO đối với các Tác nhân vô trách nhiệm”. Đạo luật này sẽ cấm các công ty Trung Quốc mà không đáp ứng được các yêu cầu công bố thông tin khỏi việc niêm yết tại Hoa Kỳ. Ông Chris Iacovella, Giám đốc điều hành tại Hiệp hội Chứng khoán Hoa Kỳ, ủng hộ đạo luật này, đồng thời kêu gọi chấm dứt việc ĐCSTQ tiếp cận thị trường vốn ở Hoa Kỳ.
Một đạo luật tương tự khác là “Đạo luật về trách nhiệm giải trình của các công ty nước ngoài” cho phép các cơ quan quản lý Hoa Kỳ sử dụng quy trình nhanh gọn hơn để hủy niêm yết đối với các công ty Trung Quốc không tuân thủ luật. Luật hiện hành cho thời gian 3 năm để các công ty Trung Quốc ‘sửa chữa’ trước khi bị hủy niêm yết. Luật mới sẽ cắt giảm xuống còn 2 năm. Trong số các yêu cầu khác về việc công bố thông tin, các nhà quản lý Hoa Kỳ kêu gọi các công ty Trung Quốc công bố mức độ kiểm soát mà ĐCSTQ áp đặt lên họ.
Bộ trưởng Thương mại Hoa Kỳ Gina Raimondo xác nhận rằng ĐCSTQ đang không tuân thủ các cam kết của mình theo thỏa thuận thương mại Giai đoạn I, đồng thời đang ngăn cản các hãng hàng không do Bắc Kinh kiểm soát mua các đơn hàng trị giá hàng chục tỷ USD từ hãng Boeing của Mỹ. Ngoài ra, một trong những lo ngại lớn nhất của Hoa Kỳ là các khoản vay ưu đãi mà ĐCSTQ đang cấp cho các công ty thuộc nhóm ‘được ưu đãi’. Đây là ví dụ rõ ràng về “các hoạt động phi thị trường không công bằng” do nhà nước Trung Quốc thực hiện. Các công ty Hoa Kỳ, đối mặt với áp lực thị trường, phải tự huy động vốn, và cần kiếm lợi nhuận, không thể cạnh tranh được với các công ty Trung Quốc do nhà nước sở hữu, kiểm soát, và bảo trợ.
Ngoài vấn đề thương mại, ông Tần Cương cũng bày tỏ sự tức giận của ĐCSTQ đối với việc Cơ quan Tình báo Trung ương Hoa Kỳ thiết lập “Trung tâm Nhiệm vụ Trung Quốc” – một động thái mà ông Tần gọi là “một tính toán sai lầm nghiêm trọng”. Ông Tần cũng cáo buộc Hoa Kỳ đang bắt đầu một cuộc chiến tranh lạnh mới với Trung Quốc.
Sau cuộc gặp giữa bà Tai và ông Tần, nhiều bài báo đã đăng tải thông tin Trung Quốc đàm phán về việc dỡ bỏ thuế quan, mặc dù không rõ Bắc Kinh đưa ra lời đề nghị gì, nếu có. Theo bà Tai, có vẻ như Trung Quốc không có kế hoạch thực hiện những thay đổi có ý nghĩa, tức là Hoa Kỳ sẽ tiếp tục duy trì thuế quan và các hạn chế.
Hoa Kỳ vẫn đang tiến hành các cuộc điều tra nhằm ngăn chặn hơn nữa việc Trung Quốc tiếp cận thị trường Hoa Kỳ một cách bất công bằng, trên cả khía cạnh thương mại và đầu tư. Bắc Kinh đã bày tỏ sự phẫn nộ, nhưng không có động thái nào để giải quyết những bất bình. Bà Tai nói rằng bà không ủng hộ một sự “tách rời” khỏi Trung Quốc, mà thay vào đó, bà chủ trương “tái hợp” theo các quy tắc mới, công bằng hơn. Có vẻ như, nếu điều bà Tai mong muốn sẽ xảy ra thì đó vẫn còn là một chặng đường dài phải đi trong tương lai.
